Se remitió el expediente contentivo de la tutela propuesta por el ciudadano de la referencia contra la Empresa Nacional de Telecomunicaciones Telecom en liquidación, al Juzgado 42 Penal del Circuito de Bogotá para que tramite y decida en forma inmediata.
La Corte estimó que la interpretación correcta de la expresión “se repartirán para su conocimiento” del Art. 1º del Decreto 1382 de 2000, debe entenderse en el contexto de la competencia a prevención y de la libertad del actor, en los términos de los Arts. 86 de la Constitución, 37 del Decreto 2591 de 1991 y 1º del Decreto 1382 de 2000.
